Accepting these terms
These terms cover your use of the Orange Concrete Company website and any estimate, quote or work we provide. By using the site or hiring us, you agree to them. If you don't agree, please don't use the site or book work with us.
When we say "we," "us" or "our," we mean Orange Concrete Company. "You" means the person using the site or the property owner we're working for. If a signed contract for your job says something different from these terms, the contract controls for that job.
What we do
Orange Concrete Company is a concrete contractor in Orange, TX. We build driveways, patios, sidewalks, steps, slabs, foundations, retaining walls and other flatwork, which is the flat concrete around a house or business, for customers in Orange and the cities around it in Texas and Louisiana. You can read more about who we are on our About page and find our services from the home page.
The descriptions, photos and general information on this site explain the trade in general terms. They aren't a promise about your job, because every property is different. What we'll do on your property is set out in your written estimate or contract.
Estimates and pricing
Estimates are free and are done on site, because the price of concrete work depends on things we can only judge in person, such as the size of the area, the condition of the ground, where water drains, access for the trucks and the finish you choose. Asking for an estimate doesn't obligate you to anything.
An estimate is our price for the work it describes, based on what we can see, and it stays good for the period written on it. If we open up the job and find something nobody could see beforehand, such as soft or wet subgrade, which is the ground the slab sits on, buried debris, old concrete or large roots, we'll stop, show you what we found and agree on any change in writing before doing extra work at extra cost.
If material prices change sharply between your estimate and the scheduled pour, we'll tell you before work starts so you can decide how to go ahead.
Scheduling, weather and cancellation
Once you accept an estimate, we'll give you a planned start date. Concrete depends on the weather, so we may move a pour for rain, cold or heat that would weaken the slab, and we'll let you know as early as we can. A weather delay isn't a breach of these terms by either side.
If you need to cancel or reschedule, call us at (409) 216-5078 as soon as you can. You can cancel without charge before we order materials or start work. After that, you're responsible for any materials ordered for your job that can't be returned and for work already done, as listed in your contract.
Please make sure the work area is clear and we can get to it on the scheduled day. If our crew can't start because of something on your side, we'll reschedule and may charge any trip costs your contract lists.
Your responsibilities as the property owner
Unless your written agreement says we'll handle it, you're responsible for confirming your property lines, getting any homeowners association approval and checking with your city or county whether your job needs a permit.
Tell us about sprinkler lines, septic systems, private electric or gas lines and anything else buried in the work area. We aren't responsible for damage to private lines you didn't tell us about.
New concrete needs time to cure, which is the wait while it hardens to full strength. Keep people, pets and vehicles off it for as long as we tell you, because using it early is a common cause of cracks and marks that can't be fixed afterward. We aren't responsible for damage caused by use before the time we gave you.
Payment terms
Payment terms, including any deposit and when the balance is due, are written in your estimate or contract. Unless it says otherwise, the balance is due when the work is finished.
If a payment is late, we may pause work until it's paid and charge any late fees your contract allows, within the limits of the law. You agree to pay reasonable costs we incur collecting an overdue balance, and we keep the lien rights the law gives contractors in the state where the work is done.
Our guarantee and what concrete can't promise
Satisfaction is guaranteed on every job. If something isn't right, call us and we'll come look at it. Any written warranty in your contract sets out exactly what's covered and for how long.
Concrete can crack as it shrinks and as the ground under it moves. We cut control joints, which are planned grooves that give cracks a place to form, but hairline cracks, small color differences and minor surface variation are normal for concrete and aren't defects.
We aren't responsible for damage caused by things outside our control, such as soil movement, flooding, tree roots, loads heavier than the slab was built for, deicing salts or other chemicals, or lack of upkeep.
Except for what's written in your contract and these terms, our work and this website are provided as they are, without other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the extent the law allows.
Limits on our liability
To the extent the law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We aren't liable for indirect, incidental or consequential losses, such as lost use of your property, lost income or the cost of other arrangements while work is underway.
Nothing in these terms limits liability that the law doesn't allow us to limit, such as liability for gross negligence or willful misconduct.
Using this website
The text, photos and design on this site belong to Orange Concrete Company. You're welcome to read and share links to our pages, but please don't copy or reuse our content without permission.
We try to keep the site accurate, but it's general information and may contain errors or go out of date. Links to outside websites are there for convenience, and we aren't responsible for their content.
Settling a disagreement
If you have a problem with our work or a bill, call us first. Most issues get settled with a visit and a conversation, and we'll try in good faith to make it right.
If we can't settle it within 30 days after you tell us about it in writing, either side may take the matter to the state or federal courts serving Orange County, Texas, or to small claims court where the amount qualifies. Where the law gives either side a right to notice, or a chance to inspect and repair, before a lawsuit, those rights apply.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. For work we do in Louisiana, any Louisiana law that can't be set aside by agreement still applies to that job.
Changes to these terms
We may update these terms from time to time by posting the new version on this page. The version in effect when you sign your contract applies to that job, and using the site after an update means you accept the new terms.
If any part of these terms is found unenforceable, the rest still applies.
